In others like Liberia and Sierra Leone, civil wars between weak states and rebel groups led to widespread violence, destruction of homes and infrastructure, and large-scale displacement.

    Three trends in particular have affected the role of territoriality in international law: the move towards functional regimes, the rise of cosmopolitan projects claiming to transgress state boundaries, and the development of technologies resulting in the need to address intangible, non-territorial, phenomena. In Canadian and New Zealand law, fundamental justice is the fairness underlying the administration of justice and its operation. The principles of fundamental justice are specific legal principles that command "significant societal consensus" as "fundamental to the way in which the legal system ought fairly to operate", per R v Malmo-Levine. These principles may stipulate basic procedural.

    John Rawls aims to express an essential part of the common core of the democratic tradition--justice as fairness--and to provide an alternative to utilitarianism, which had dominated the Anglo-Saxon tradition of political thought since the nineteenth century. Rawls substitutes the ideal of the social contract as a more satisfactory account of the basic rights and liberties of citizens as free 4/5(17). According to Rawls (), social justice is about fair-ness. Justice also depends upon giving individuals cap-ability, which in this case will be ‘capability to be healthy’. Towards functional justice book Transitional justice practitioners and policy makers are often called on to take context into greater consideration.
